1. Introductory Provisions

1.1. These Terms of Service (hereinafter "Terms") of Poctailor s.r.o., with registered office at Sokolovská 428/130, Karlín, 186 00 Prague, Company ID: 22097643 (hereinafter "Seller") govern the mutual rights and obligations of contracting parties arising in connection with or based on a purchase agreement (hereinafter "Purchase Agreement") concluded between the Seller and another natural or legal person (hereinafter "Buyer") through the Seller's online store.

1.2. The online store is operated by the Seller at the website www.poctailor.eu (hereinafter "Website").

1.3. Provisions deviating from the Terms may be negotiated in the Purchase Agreement. Deviating provisions in the Purchase Agreement take precedence over the provisions of these Terms.

1.4. The provisions of these Terms form an integral part of the Purchase Agreement. The Purchase Agreement and the Terms are drawn up in Czech. The Purchase Agreement may also be concluded in English.

2. User Account

2.1. Based on the Buyer's registration on the Website, the Buyer may access their user interface.

2.2. When registering, the Buyer is obliged to state all data correctly and truthfully. The Buyer is obliged to update the data provided in the user account whenever it changes.

3. Conclusion of the Purchase Agreement

3.1. All presentation of goods on the web interface of the store is informative in nature and the Seller is not obliged to conclude a Purchase Agreement regarding these goods.

3.2. The web interface of the store contains information about the goods, including their prices. Prices of goods are shown including VAT and all related fees. Prices remain valid for as long as they are displayed on the Website.

3.3. To order goods, the Buyer fills out the order form. The Buyer submits the order to the Seller by clicking the "Order with Obligation to Pay" button.

3.4. The Seller shall confirm receipt of the order to the Buyer without undue delay by electronic mail.

3.5. The contractual relationship between the Seller and the Buyer arises upon delivery of order acceptance (acceptance) by the Seller.

4. Price of Goods and Payment Terms

4.1. The Buyer may pay the price of the goods and any costs associated with delivery to the Seller in the following ways:

cashless payment by payment card via the ComGate payment gateway;
cashless payment by bank transfer via the ComGate payment gateway;
cashless payment by QR code via the ComGate payment gateway;
based on an advance invoice (upon agreement).

4.2. The ComGate payment gateway is operated by Comgate, a.s. Details are available at www.comgate.cz.

4.3. All prices on the Website are shown in Czech crowns (CZK). International customers pay in CZK; conversion to the local currency is handled by the card issuer or bank.

4.4. The Seller shall issue a tax document — an invoice — for the payment and send it electronically to the Buyer's e-mail address.

5. Withdrawal from the Purchase Agreement

5.1. The Buyer has the right to withdraw from the Purchase Agreement within fourteen (14) days of receiving the goods.

5.2. Details are provided in the Complaints and Withdrawal Policy.

6. Transport and Delivery of Goods

6.1. Transport and delivery terms are set out in a separate document — Shipping and Delivery Terms.

7. Rights Arising from Defective Performance

7.1. Details for filing a claim are set out in the Complaints Policy.

8. Special Provisions for In-Vitro Diagnostic Medical Devices

8.1. In-vitro diagnostic medical devices (IVDs) sold are compliant with EU Regulation 2017/746 (IVDR), bear the CE mark, and are notified with the State Institute for Drug Control (SÚKL).

8.2. Certain products are intended exclusively for professional use by healthcare workers and healthcare service providers. These products are available in the online store only through the Partner Zone.

9. Personal Data Protection

9.1. Personal data protection is governed by a separate document — Privacy Policy.

10. Out-of-Court Dispute Resolution

10.1. Consumers may file a proposal for out-of-court settlement of consumer disputes with the Czech Trade Inspection Authority or another authorised ADR body.

10.2. Consumers also have the right to use the Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr/.

11. Final Provisions

11.1. The contractual relationship is governed by Czech law, unless a provision of the consumer's country of residence is more favourable.
